Cannabis Excise Tax Effective January 1, 2018, a 15 percent excise tax is imposed upon retail purchasers of all cannabis and cannabis products, including medicinal cannabis. The 15 percent excise tax is calculated based on the average market price from the retail sale. Please refer to the heading, Average Market Price, below for more information. As a retailer, you are required to pay the cannabis excise tax to your distributor and collect the cannabis excise tax from your customers. No cannabis and/or cannabis products may be sold unless the cannabis excise tax is paid by the purchasers (consumers) at the time of sale. Starting January 1, 2018, your distributor will calculate the amount of excise tax due on the cannabis or cannabis products which they supply to you. However, you may have cannabis or cannabis products in your store on or after January 1, 2018, that you acquired prior to January 1, 2018, upon which you did not pay the excise tax to a distributor. Beginning January 1, 2018, if you sell cannabis or cannabis products that you acquired before January 1, 2018, you must collect the 15 percent cannabis excise tax from your customers based on the average market price and pay the excise tax on those sales to a licensed distributor with whom you have a business relationship (that is, a distributor that you purchase or acquire cannabis or cannabis products from on or after January 1, 2018). See the “Average Market Price” heading below for more information on how to determine the average market price. You must pay the 15 percent cannabis excise tax due on your retail sales of cannabis or cannabis products that you purchased prior to January 1, 2018, to a licensed distributor by the fifteenth of the following month in which you collected the tax.
